Online Banking Agreement & Disclosure

Introduction. This Online Banking Agreement and Disclosure (“Agreement”) states the terms and conditions concerning American 1 Credit Union’s Online Banking services. By using the Online Banking services you agree to abide by the terms and conditions of this Agreement. This Agreement is an addendum to the existing Membership and Account Agreements, amendments, disclosures, and any other agreements with American 1, notwithstanding any provision in this Agreement to the contrary. 

Definitions. As used in this Agreement the terms “You” and “Your” refer to each member and Authorized Person who has enrolled in American 1 Credit Union’s Online Banking. The term “American 1” refers to American 1 Credit Union. The term “Authorized Person” refers to the person designated by the member to transact any and all business in American 1’s Online Banking.

1. Acceptance of this Agreement by Use. Use of Online Banking signifies your agreement with the following terms of use. If you do not agree with any of these terms of use, please do not enroll and use the Online Banking services. American 1 reserves the right, in its sole discretion, to modify this Agreement at any time, and you agree to be bound by such modifications through your continued use of American 1’s Online Banking
2. American 1’s Unilateral Right. American 1 may terminate your access to Online Banking at any time in its sole discretion.
3. Security & Effect of Online Credentials. The username, password, security phrase, security image, and challenge questions and answers that you select are for your security purposes and are collectively identified as your online credentials. These credentials are confidential and should not be disclosed to third parties or recorded. You are responsible for the safekeeping of your online credentials. You agree not to disclose or otherwise make available to anyone not authorized to use your accounts. American 1 is entitled to act on transaction instructions received using your online credentials. You agree that the use of your online credentials will have the same effect as your signature authorizing transactions.
4. Authorized users. If you authorize anyone to have or use your online credentials, you understand that person may use Online Banking to review your account information and make account transactions. If you authorize anyone to use your online credentials in any manner that authority will be considered unlimited in amount and manner until you specifically revoke such authority by notifying American 1 and changing your online credentials.
5. Member Liability. You are responsible for all transfers you authorize using Online Banking. If you permit other persons to use your online credentials, you are responsible for any transactions they authorize or conduct on any of your accounts until you notify American 1 that transactions and access by that person are no longer authorized and your online credentials have been changed.
6. Notify Immediately of Unauthorized Transactions. Immediately notify American 1 by calling (888) 213-2848 or (517) 787-6510 if you believe that your username, password, or other online credentials have been stolen, compromised, or used without your authorization. Immediately calling American 1 is the best way of reducing your possible losses. If you do not call American 1, you could lose all the money in your account (plus your maximum line of overdraft credit amount.)
7. Messages Feature. Using the Messages Feature (“Email”) is a convenient way to communicate with American 1. Email is provided for you to ask questions about your account and to provide general feedback. American 1 may not immediately receive any email communications that you send and American 1 will not take action based on email requests until American 1 actually receives your message and has a reasonable opportunity to act. If you need to contact American 1 immediately regarding an unauthorized transaction or stop payment request, please call (888) 213-2848 or (517) 787-6510.
8. Account Alerts Feature. The Account Alerts Feature is a personal financial information alert service that allows you to receive information about your account. You understand and agree that receipt of each Alert may be delayed, or prevented by factors affecting your Internet or wireless service providers and that message and data rates may apply. Alerts may not be sent on a real time basis, but may be sent at the next scheduled delivery time after the specified event occurs. American 1 reserves the right to change or cancel the Account Alerts Feature at any time and without notice.  Limitations on Service: Balances shown on Alerts may not reflect actual available balances. American 1 does not guarantee the delivery or accuracy of the content of any Alert. You understand and agree that American 1 will not be liable for losses or damages arising from non-delivery, delayed delivery, or mis-delivery of an Alert; inaccurate content in an Alert; or your use or reliance on the contents of any Alert for any reason.
9. Choice of Law. This Agreement is subject to the federal laws of the United States and the laws of the State of Michigan. If any of the terms of this Agreement cannot be legally enforced, they will be considered changed to the extent necessary to comply with applicable law.
10. Your Acceptance. By checking the “I Accept” box to access American 1’s Online Banking you represent that you have read, fully understand, and accept the terms of this Agreement.
